Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the MyFollowUp mobile application ("App"), operated by RD Technology LLC ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

Description of Service

MyFollowUp is an SMS retention and rebooking platform designed for local service businesses. The App allows business owners to manage customer contacts, create personalized follow-up messages, schedule automated SMS sends, and track customer engagement — all in one place. Core features include follow-up reminders, reactivation campaigns, review requests, rebooking messages, and AI-assisted message generation.

Eligibility

You must be at least 18 years of age and operate a legitimate business to use MyFollowUp. By using the App, you represent that:

• You meet the age requirement
• You have the legal authority to bind yourself or your business to these Terms
• All information you provide is accurate and current
• You will use the App only for lawful business purposes

SMS Messaging and Legal Compliance

MyFollowUp sends SMS messages to your customers on your behalf. This is the core function of the App, and with it comes significant legal responsibility. By using the App's messaging features, you represent, warrant, and agree that:

• You have obtained proper, documented consent from each customer before sending them any SMS message through the App
• You will comply with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, all applicable state and local laws, and all wireless carrier guidelines governing commercial SMS messaging
• You understand and comply with A2P 10DLC requirements for business messaging
• You will honor all opt-out requests immediately — any customer who replies STOP must be removed from future messaging
• You will not send messages that are deceptive, harassing, threatening, or illegal in any way
• You are solely responsible for the content of all messages sent through your account

We reserve the right to suspend or terminate accounts that violate messaging laws or carrier guidelines without prior notice.

Acceptable Use

You agree to use MyFollowUp only for its intended purpose — legitimate business follow-up communication with your own consenting customers. You agree not to use the App to:

• Send messages to individuals who have not consented to receive communications from your business
• Send spam, bulk unsolicited messages, or phishing content
• Impersonate any person, business, or entity
• Violate any applicable law or regulation
• Attempt to access other users' accounts or data
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Use the App in any way that could damage, disable, or impair its infrastructure

Subscription and Payment

MyFollowUp is offered on a paid subscription basis. Subscriptions are managed through the Google Play billing system and RevenueCat.

• Subscription fees are billed in advance on a recurring basis (monthly or annual)
• Your subscription automatically renews unless cancelled at least 24 hours before the end of the current period
• You can manage or cancel your subscription at any time through your Google Play account settings
• Cancellation takes effect at the end of the current billing period — you retain access until then

We reserve the right to change pricing with reasonable advance notice. Continued use after a price change constitutes acceptance of the new pricing.

Refunds

Refunds are subject to Google Play's refund policy. We do not offer refunds for partial subscription periods or for unused features, except where required by applicable law. If you believe you were charged in error, contact us within 30 days at admin@rdtechnologyllc.org.

Your Data

You retain ownership of all customer contact data and message content you create within the App. By using the App, you grant us a limited license to process and store that data solely as necessary to provide the service. We will never use your customer data for our own marketing or share it with third parties except as described in our Privacy Policy.

You are responsible for ensuring your use of customer data complies with all applicable privacy laws.

Intellectual Property

The MyFollowUp App — including its design, code, features, branding, and content — is owned by RD Technology LLC and protected by intellectual property law. Nothing in these Terms grants you ownership of any part of the App.

Disclaimers

The App is provided "as is" and "as available." We make no warranties, express or implied, regarding the App's reliability, uptime, accuracy, or fitness for any particular purpose. SMS delivery is subject to carrier infrastructure and is not guaranteed. We are not liable for undelivered messages, carrier filtering, or third-party service outages.

Limitation of Liability

To the maximum extent permitted by law, RD Technology LLC's total liability to you for any claim arising from these Terms or your use of the App shall not exceed the subscription fees you paid in the three months immediately preceding the claim. We are not liable for any indirect, incidental, consequential, or punitive damages.

Indemnification

You agree to defend, indemnify, and hold harmless RD Technology LLC, its officers, and employees from any claims, losses, or expenses — including legal fees — arising from your use of the App, your violation of these Terms, your violation of any applicable law, or any claims by your customers related to messages you sent through the App.

Termination

You may stop using the App and cancel your subscription at any time. We may suspend or terminate your account immediately if you violate these Terms, engage in prohibited messaging behavior, or for any other reason at our reasonable discretion. Upon termination, your right to use the App ends immediately and we may delete your account data consistent with our Privacy Policy.

Governing Law

These Terms are governed by the laws of the State of California without regard to conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Riverside County, California, and you consent to personal jurisdiction in those courts.

Changes to These Terms

We may update these Terms at any time. We will notify you of material changes through the App or by email. Your continued use of the App after the effective date of changes constitutes acceptance. If you do not agree to updated Terms, you must stop using the App and cancel your subscription.
